District Attorney Clark Advocates for Stricter Laws to Protect Bronx Small Businesses

Bronx District Attorney Darcel D. Clark has taken a bold stance on community safety and violence prevention, urging local leaders to consider tightening laws surrounding cannabis offenses and retail theft to safeguard small businesses in the Bronx.

In a recent letter addressed to 12 Business Improvement District (BID) leaders and elected officials, Clark highlighted the pressing need for stricter legislation, emphasizing that current laws are inadequate in shielding Bronx communities from criminal activities that threaten the livelihood of local entrepreneurs. She expressed concerns that the existing legal framework falls short in providing sufficient protection for businesses in the area.

### Cannabis Regulation Challenges

One of the key issues raised by Clark pertains to the state’s Marijuana Regulation and Taxation Act of 2021, which aimed to address the disproportionate impact of mass incarceration on Black and brown individuals. However, Clark pointed out a critical flaw in the legislation, citing the use of “pure weight” instead of “aggregate weight” in measuring cannabis, which has created a legal loophole that hampers effective prosecution of illegal cannabis possession and sale.

Under the current standard, cannabis offenders may evade accountability due to the narrow focus on pure THC content, while disregarding the total weight of the substance seized, including non-psychoactive components like stems and seeds. Clark highlighted instances in Brooklyn where cases were dismissed due to this discrepancy and expressed concerns that similar challenges could arise in the Bronx, necessitating potential amendments to the existing laws to ensure robust enforcement against unlicensed cannabis dealers.

### Retail Theft Concerns

In addition to cannabis-related issues, Clark underscored the persistent problem of retail theft in the Bronx, noting that lenient bail and discovery reforms introduced in 2020 have inadvertently fueled recidivism among offenders. Despite the well-intentioned efforts to rectify past injustices in the criminal justice system, Clark emphasized the adverse “collateral consequences” of these reforms, particularly in cases involving property crimes like retail theft.

Clark emphasized the detrimental impact of these criminal activities on hardworking local entrepreneurs, who face significant challenges in maintaining economic viability amidst surrounding illicit practices. She called for a concerted effort to address these pressing issues and ensure a safer environment for Bronx businesses to thrive.
